4. Orders

We reserve the right to refuse or cancel an order in reasonable circumstances, including suspected fraud, pricing errors, product availability issues or circumstances beyond our reasonable control.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.

5. Prices and Payment

All prices displayed on the website are stated in euros and include applicable VAT where required by law, unless clearly stated otherwise.

Shipping costs and any other additional charges will be shown before you complete your purchase.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been confirmed, except where a clear pricing or technical error has occurred.

Delivery times are estimates and are not guaranteed unless expressly stated otherwise.

Depending on the products ordered, items may be fulfilled from different warehouses or fulfilment locations. As a result, an order may arrive in separate shipments and individual products may have different delivery times.

If a delivery is delayed, we will make reasonable efforts to assist you and provide relevant information.

Nothing in these Terms & Conditions limits your statutory rights regarding delivery or non-delivery of an order.

7. Right of Withdrawal

When you purchase products from Circavora as a consumer, you generally have a statutory 14-day withdrawal period for online purchases.

The withdrawal period starts on the day after you, or a third party designated by you, receives the product. For orders delivered in multiple shipments, the withdrawal period generally starts when you receive the final product forming part of the order.

You may exercise your right of withdrawal without giving a reason.

You may use the withdrawal form provided by Circavora, but you are not required to use a specific format as long as you clearly communicate your decision to withdraw.

After notifying us of your withdrawal, you must return the product within 14 days.

Exceptions

The right of withdrawal does not apply in situations where the law provides an exception, for example for certain personalised products, sealed products that are unsuitable for return for health or hygiene reasons once unsealed, or other statutory exceptions.

Where an exception applies, this will be communicated clearly before or during the purchase process where required.

8. Returns

Products returned under the statutory withdrawal right must be returned within 14 days after you have notified us of your decision to withdraw.

You are responsible for handling the product with reasonable care during the withdrawal period. You may inspect and handle the product only to the extent necessary to establish its nature, characteristics and functioning, as you would reasonably be allowed to do in a physical store.

If the product has been used or handled beyond what is necessary to assess it, you may be liable for any resulting reduction in value, where permitted by law.

Return costs are the responsibility of the customer unless Circavora has stated otherwise or applicable law requires us to bear them.

The applicable return address and return instructions will be provided by Circavora when a return is requested.

9. Refunds

When you validly exercise your right of withdrawal, Circavora will refund the payments received from you, including the standard delivery costs associated with the original order where required by law.

If you selected a more expensive delivery option than our standard delivery method, we are not required to reimburse the additional cost.

Refunds will generally be made using the same payment method used for the original transaction, unless otherwise agreed.

We may withhold the refund until we have received the returned product or until you have provided evidence that the product has been returned, whichever occurs first, where permitted by law.

We will process refunds within the statutory period.

10. Legal Guarantee and Product Conformity

All products sold by Circavora are covered by the statutory consumer rights and legal guarantee applicable in the country of purchase.

Products must conform to the agreement, including being suitable for their normal use and matching the description and characteristics provided at the time of purchase.

Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a price reduction or termination of the agreement and a refund.

Any commercial or manufacturer's warranty offered in addition to your statutory rights does not limit those rights.

Circavora will not be responsible for delays or failures caused by circumstances beyond our reasonable control, such as natural disasters, severe weather, transport disruptions, strikes, government measures, technical failures or other events that could not reasonably have been prevented.

Changes will not affect rights that you have already acquired under applicable law.

19. Governing Law and Consumer Rights
